Property Issues
Ontario is not a community property jurisdiction. In other words, the mere fact that you cohabit or are married to each other does not necessarily
entitle you to have a valid claim against property owned by the other
person in the relationship. In the case of cohabiting persons, property issues can be very complicated
since, in these cases, we have mostly had to deal with the law of equity
or what is fair, as opposed to statute law. However, even in the case of married persons, the
statutes still do not address ownership of property (for the most part), but are mainly concerned with ensuring that
the net value of the property acquired by both persons during the marriage is equally shared.
Furthermore, such equalization can involve some very complicated and time-consuming calculations, especially in
cases involving such tough to value assets as pensions and business interests.
